Production applicative certificates now available for download

FINA has started issuing the production applicative certificates on 26 November 2012. As the download procedure for the new certificates is different from the demo certificate procedure, the Prescribed procedure for applicative fiscalization certificates should be completely adhered to.

All fiscalization subjects are required, for the purpose of implementing cash transaction fiscalization, to acquire a production applicative certificate which will be used in the fiscalization procedure to electronically sign receipt elements and to identify the fiscalization subject during electronic data interchange.

The IT company implementing the subject's fiscalization system cannot acquire a production applicative certificate in his name, i.e. the production certificate must be requested by the fiscalization subject himself. If necessary, the authorized person (e.g. the managing director) can give the power of custody to a person which is not the employee of his firm (e.g. an employee of the IT company which is in charge of implementing the subject's fiscalization system), who could, in that case, acquire the certificate on behalf of the fiscalization subject.

The Fiscalization Act passes the vote, to be enacted on 1 January 2013!

The Final proposal of the Act was sent to the Parliament after having been accepted at the Government session of 8 November 2012.

A long discussion about the Cash Transaction Fiscalization Act has been finalized in the Croatian Parliament, and concluded on 21 November 2012. The Act passed the vote during the Sixth session on 23 November 2012 with 80 Yeas, 2 Nays, and 32 Abstains.

Fiscalization seminars

The representatives of the Croatian Government have announced that the Tax Administraion will organize a campaingn in which, through media and organized seminars, the public will be informed about the implementation of this Act, with the goal of creating a positive public opinion regarding the necessity of introducing cash transaction fiscalization.

The seminars will be held in:

- METKOVIĆ: 26 November 2012 (Monday) at 13:00 hours, at Metković City Hall (the seat of political parties);
- DUBROVNIK: 28 November 2012 (Wednesday) at 10:00 hours, at the Dubrovnik Tax Administration branch office, Vukovarska 6, Dubrovnik
- KORČULA: 30 November 2012 (Friday) at 13:00 hours, at the Korčula Cultural center, Obala korčulanskih branitelja bb, Korčula
- KRAPINA: 26 November 2012 (Monday) at 10:00 hours, at the Croatian Chamber of Economy, ŽK Krapina, Trg Ljudevita Gaja 5, Krapina
- POŽEGA: 29 November 2012 (Saturday) from 09:30 until 13:30 hours, in the Great chamber of the Croatian Chamber of Economy, ŽK Požega, Vukovarska 6, Požega

Bar and restaurant owners and tourism workers from the Croatian Chamber of Economy have requested from the Government to delay the enactment of the Fiscalization Act until 1 July 2013, the date of Croatia's admission to the European Union. According to current information, the Government does not intend to delay the enactment.

New technical specification

xmlIn accordance with the Final proposal of the Cash Transaction Fiscalization Act, which will undergo its second reading in the Croatian Parliament, the Tax Administration has accepted the representatives' observations and comments, and included the modifications requested by fiscal software developers. That is why the technical specification was updated, and is currently in its 1.1 version.

One of the main changes which will ensure that fiscal software will not be used illegally (i.e. pirated) is the inclusion of software developer information in the xml message.

Also, the description of the business premises request message will be modified.

In the part related to the Specific purpose, it will be necessary to enter one of the following required information:
OIB of the legal or natural person which has produced the program solution, or
OIB of the legal or natural person which does maintenance of the program solution, or
OIB of the legal or natural person who is the vendor, in cases when a foreign software solution is used, without a local partner.

The data receiving service in the test environment will be operational according to the new specifications starting on Monday, 5 November 2012 after 17:00 hours.
